Acceptance of Terms
By activating, accessing, renting, or using the Internet, VoIP, or related equipment provided by Fusion Cabling Inc. (“we”, “us”, “our”), you acknowledge and agree to be bound by these Terms of Service. Your use of the service constitutes acceptance.

1. Scope of Service
Fusion Cabling Inc. provides Internet and VoIP connectivity, along with related equipment when applicable. Service availability and performance may depend on external network infrastructure that is outside of our direct control.

2. Service Limitations
- We make no warranty, express or implied, about the speed, uptime, quality, or reliability of the connection.
- Service may be interrupted, slowed, suspended, or terminated without notice due to factors beyond our control.
- Latency, jitter, call quality, bandwidth limitations, or outages are inherent risks of Internet and VoIP technologies, including satellite and cellular-based networks.

3. Limitation of Liability
You agree that we are not responsible or liable for:
- Any loss, interruption, or degradation of service.
- Any damages, direct or indirect, including loss of business, revenue, or data.
- Any failures, delays, or deficiencies caused by underlying network infrastructure or other third-party systems.
Our role is limited to providing access to these services and equipment. Your sole remedy for service issues is to discontinue use of the service.

4. Equipment Rental & Use
If you rent or borrow equipment from us (such as routers, antennas, VoIP hardware, Satalite terminals, or accessories):
- You are responsible for proper use and routine care of the equipment.
- You must return the equipment in good working condition upon request or at the end of the rental term.
- You will be charged the replacement cost for any equipment that is lost, stolen, damaged, or not returned.
- You are responsible for providing suitable power, grounding, environment, and installation conditions for operation.
- Any tampering, unauthorized modification, or use outside of intended purpose may void support and result in fees.

5. Customer Responsibilities
You agree to:
- Use the services lawfully and in compliance with applicable regulations.
- Be responsible for all activity on your connection.
- Ensure that your usage complies with acceptable use standards.
- Cover any costs incurred as a result of misuse, illegal activity, or violations originating from your account or equipment.

6. Payment & Fees
- You agree to pay all fees associated with the service and equipment rental.
- Late payments may result in suspension or termination of service.
- Unreturned or damaged equipment may be billed automatically at replacement cost.

7. Service Termination / Suspension
- We reserve the right to suspend or terminate service for non-payment, misuse, abuse, or violation of these terms.
- Termination does not release you from responsibility for outstanding charges.

8. Data Privacy, Security & Monitoring
- We do not inspect or monitor your content, except as required by law or as technically necessary to maintain the service.
- We do not guarantee the security of any data transmitted while using the service. Internet and VoIP connections may be subject to interception, monitoring, or unauthorized access by third parties.
- You are solely responsible for securing your own devices, accounts, passwords, and data through appropriate measures (such as firewalls, antivirus software, and encryption).
- Fusion Cabling Inc. is not responsible or liable for any unauthorized access, data breaches, viruses, malware, ransomware, or other security incidents affecting your equipment or information while using the service.

9. Emergency Services (VoIP 911)
- VoIP 911 calls may be routed differently than traditional phone services and may be limited or unavailable during power outages, Internet interruptions, or equipment failure.
- You must ensure you have alternative means of accessing emergency services.
- By using our VoIP service, you acknowledge these limitations and accept the associated risks.

10. Force Majeure
We are not responsible for delays or failures caused by events beyond our reasonable control, including natural disasters, severe weather, acts of government, labor disputes, or third-party network failures.

11. Indemnification
You agree to indemnify and hold harmless Fusion Cabling Inc. from any claims, fines, losses, or damages arising from your use of the service or equipment, including complaints about illegal activity, misuse, or network abuse.

12. Modifications to Terms
We reserve the right to update these Terms of Service. Continued use of the service after notice of changes constitutes acceptance of the revised terms.

13. Governing Law
These terms are governed by the laws of the Province of Manitoba and the applicable federal laws of Canada.
